Court Rules in Armslist Favor Once Again

BOSTON, MASSACHUSETTS -  Armslist LLC announced that it has successfully defended itself against a Brady backed lawsuit.  Brady was established in 1980 as Handgun Control Inc.

In Stokinger v. Armslist, Brady argued before the Massachusetts Superior Court that the Safe Harbor of the Federal Communications Decency Act, 47 USC. 230, does not apply to the Armslist.com website because the website permits users to search and filter third party classified listings, such as by product make, model, item location, and seller type (i.e., dealer or private party).  The court disagreed with Brady and ruled that the CDA 230 Safe Harbor applies to the website because Armslist does not create the third party classified listings, nor is Armslist directly involved in the transaction.  The court cited and followed the recent Wisconsin Supreme Court and United States Court of Appeals for the Seventh Circuit decisions, in which Armslist prevailed against Brady on the same issue.

“We defended the foundation of the Internet against another assault, aimed at destroying free speech on the Internet,” Jon Gibbon, of Armslist said. “We fought against Brady’s bullying tactics.  For almost 50 years, Brady has tried to chill constitutionally protected rights by attempting to bankrupt prominent parties who operate within constitutionally protected industries that Brady does not approve of.  Brady obviously does not care if their anti-constitutional cause results in the destruction of the Internet. ”

The Electronic Frontier Foundation has recognized CDA 230 as the most important law protecting Internet speech.  Armslist views the continued assault on CDA 230 by Brady as a severe threat to the Internet and the US economy. The success of Brady would jeopardize the continued operation of allInternet Service Providers and any online service that permits end-users to post content, and to search and filter third-party content.  Other sites that would be affected included Facebook Marketplace, Craigslist, Autotrader, Yelp, eBay, and Etsy.

Armslist has prevailed in every jurisdiction where Brady has filed suit, including the United States Supreme Court, United States Court of Appeals for the Seventh Circuit, Wisconsin Supreme Court, and Massachusetts Superior Court.

Brady recently filed another lawsuit against Armslist in Federal Court in the Eastern District of Wisconsin, putting forth the same arguments used in Stokingerand once again threatening free speech on the Internet.

Armslist is the Internet’s premier marketplace for firearms and firearms accessories.

Please join Armslist in helping to end Brady’s threat to the Internet and United States economy by donating to the Armslist Legal Defense Fund -

This is off topic for the Brady suit but in line with multiple comments I see in this thread... I too, was disappointed at the monthly fees and information required to join. I have seen a massive decline in the number of private listings and an incredible increase in ads since I first became a member. The monthly fee is too high for what I receive in return... you charge me to contact sellers and to save listings as favorites even if no transaction takes place. Ebay and other very successful sites you mention in this article do not charge the buyer to have a look at stuff and I honestly feel, neither should you. Charging a transaction based fee as some commented may entangle you into falling into the web of lies the Brady cause supports and that would be unfortunate for us all. I do not have a solution but I do feel the monthly fee is a bit high for a lot of folks including myself. Carry on, carry armed and carry safe!

$25 fee and y’all charge me at different times of month. Crazy hustle. Also enough with the racist bullshit. I’m a Nigerian who served proudly in the U.S. Army and never scammed anyone or took a free hand out. Racism = pure stupidity and ignorance. I feel sorry for the shit you will leave your children in. They can’t enjoy anything cause minorities are in everything. Going to isolate them to one place when this world has so much. I didn’t raise ammo prices or try to take anyone’s guns. Nor I I believe in poisonous welfare.

All you sniveling cheap ass itches whining about a measly 7 buck a month, GOOD RIDDANCE! This venue is a BARGAIN! $84.00 per year and I just cleared $3000.00 on one sale here on ARMSLIST! DUH??? Get a life you dumbfucks!

I have never bought anything off of here yet and it looks like I never will. I'm not going to pay for Guns Craigslist equivalent. Especially a monthly fee as big as Netflix. What new content am I getting for that fee? What is the justification or value I get back from Armslist for this cost? As a consumer, I don't see the value of me spending that big of a fee just to browse.

I agree with (most) other posters: Armslist is shooting themselves in the foot, and I ain't gonna play, either. Sad to say, but I'm outa here, too.
packrat1969 commented on 1/25/2021 8:28 AM
I oppose the idea of charging users to use this site, but I believe you regarding the legal expenses. How about a compromise? Charge a small fee for selling firearm & self-protection-related items (no frickin ATVs or unrelated crap), BUT charge NO FEES to the buyers of such goods.
Hammerdrop commented on 1/23/2021 11:18 AM
And for what... a chance to pay $300 for a $35 box of primers?
Hammerdrop commented on 1/23/2021 10:41 AM
Yes previous commenter, and one ruling for Brady can hand over the entire list of users of the site subjecting them to the SAME litigation Armslist is going through. I only make occasional purchases here and I have decided it is not worth the hassle anymore. Prolific buyers and sellers like yourself may find it worthwhile. Party on while you can. Posts are now in the 49,000 range for the entire country. When I started paying attention there were 144,000 private posts.

I've used Armslist for years and still do! I happily subscribed as it is a very small price to pay towards the mutually beneficial contribution of defending the 2nd amendment. What many, ignorant commentators, unequivocally fail to recognize, is that this: The legal attack against Armslist is unknown to majority and not in headlines anywhere. This is the Anti Gunners deliberate, methodical and Machiavellian driven process, where by starting their assault where no one is looking, they gain victory through deceit or simply gambling for one judge to agree with their side. One ruling in Brady's favor would trigger Brady to claim precedent, and immediately take aim at Gunbroker, GunsAmerica, Gunwatcher.com and ANY AND ALL WEBSITES THAT PROVIDE us means of exercising both our 1st and 2nd amendment rights. For those that don't agree with what Armslist has done with its subscription, go to another site. They did not ask for the innumerable legal challenges, battles and costs associated with defending themselves. Again, adds will only bring in so much revenue to help sustainment, but moreover, legal fees have the ability to reach 10's to 100's of thousands worth in a simply matter of months. Thank you Armslist for do the best you can during this very difficult and trying time. Best Regards & Semper Fi, Signed, The silent majority, The silent professional. Keep up the fight!

I hate to burst your bubble, but charging accounts HAS NOT STOPPED THE LOSER, NIGERIAN WANNA-BE SCAMMERS. Although I do not get as many, I am still getting them. Trying their scams, sending their pre-printed BULL-SHIT "I'm stationed overseas, I agree to your price, I'll send a money order, I'll have a courier pick them up, etc., etc., ad naseum." How about we treat these crooks the way the Saudis did when I worked contract over in Arabia? CUT THEIR THIEVING HANDS off when caught!!!
scottstokens commented on 12/20/2020 4:09 AM
Won't give a cent! You have decided on your own to start charging sellers as well as buyers to conduct a private transaction, plus you have been littering your website with ads.... G'day Sir!
Hammerdrop commented on 12/12/2020 10:39 PM
We are going a different direction now. We are going to create a database of transactions and link them to your bank account. Wait for it.... And they are going to PAY US FOR IT! BWAHAHAHAHA!
azguy15 commented on 12/12/2020 6:25 PM
I always enjoy checking out armslist to watch the latest pricing trends etc. but Rarely actually bought or sold anything . That being said if I were to buy or sell A few things each year it would cost me that much more having to pay a subscription fee each year! Seems like I’ll be better off going to the local Gun stores, Gun Shows and Pawn shops! Oh well was great while it lasted!
xensui commented on 12/10/2020 3:26 PM
Awesome! So are you going to stop charging to use you site now? Otherwise this site will dissolve basically to nothing as we can see this has already started.

Another thing, why a routing # and all these banking questions????? This makes me feel like you are bundling our banking info to sell to the dark web or the ATF???
kjeff commented on 12/5/2020 8:53 AM
This is shameful that Armslist is using its recent court victory to fleece American people. So now you want to monetize Armslist with a subscription based movement. I will never buy a subscription, however I will ask all that do to please use a phone # in the body of your add to help keep transactions private, thanks for fucking up Armslist!

I come here occasionally and do a Nationwide search by clicking the magnifier and filtering the premium venders. I have found that you have already lost well over a third of your ads and the ad count drops daily. It's like watching a snowman melt until its gone. What separates good businessmen from the bad is realizing a mistake and correcting it. People aren't going to pay to ask questions or make offers that may not be accepted. People also are not likely to want to be on a list of transactions tied to their banking accounts in this political climate. I wish you luck in finding a profitable way to run the site without running it under.
ohioguy1964 commented on 11/26/2020 1:39 PM
Guess I am done dealing with Armslist now that it subscription based. Might as well use Gun Broker to sell my stuff.

Nick Montoya commented on 11/20/2020 1:08 PM
I’ve bought alot of stuff off of Armslist over the last few years, but now that it is subscription-based I guess I’ll have to stop using it altogther. The ads were annoying but tolerable for a free site, to be honest I ignored 99% of them, however I knew they were a source of revenue needed to operate the site in a profitable manner. I used to check daily for deals so in a sense the anti-gunners got their way, I’m going to limit what I now spend on a bi-weekly basis and check the local gun stores more often. If you ever get back to a free-of-subscription model I’ll go back to using the website on a continuous basis. Thanks.
smithandwesson1993 commented on 11/19/2020 11:02 PM
Great, now cut out the paid subscriptions. It's garbage, and we all know it.
Hammerdrop commented on 11/18/2020 3:42 PM
I saw a box of ammo I wanted but when you add in the cost and hassle of registering forget it. Who other than YOU charges someone to ask the seller a question or to buy? As for selling, you have lost so many buyers why would I pay money even to try and sell?
Kennethgross100 commented on 11/16/2020 2:46 AM
This site was amazing free. Now that you guys charge for the service of having a platform for people to find products they are in search of YET still have many adds that CLUTTER up every page is unfortunate and pushed me to gunbroker more than before. Most of the ads being ridiculous spam/scam/junk mail/clickbait BS. Ads, charging to contact sellers, asking for donations to legal funding...is this "new latest and greatest....same ol armslist but costs money now website" just for legal funds for the fight for "constitutional internet rights" ? Or is it for financial gain? People making so much money during the pandemic you wanted your piece of the pie? If i was clesr on WHY your charging money for this site now at this time out of any i would be more comfortable with the fee. If your reason is because soft ass school shooter types are getting their feelings hurt and scammers are abusing the site .....i dont see how you will stop either of those with the "improvements" nor do i think everyone should have to pay because some cry baby bitches got their feelings hurt or got scammed by a too good to be true deal. Does getting scammed suck YES thats why you only do face to face or buy from a business's people. If you cant take hard "rude or inpolite communication and pricing" dude your sissy ass shouldnt have a gun because your too damn emotionally unstable. Mentally ill and emotionally sensitive people shouldnt cause us all to pay for their malfunctions and disorders.
Carl5242 commented on 11/15/2020 2:11 PM
You have some real troll on this website I think the small amount you charge for the service you provide is great especially if it helps protect everyone on this site and to enjoy the service you offer. The service you offer is worth more than you actually charge. So keep up the good work for 2nd amendment rights. The more you win the better it is because you are creating a model for future law suits and courtroom action. Thanks! Carl
Donnie92 commented on 11/9/2020 12:26 PM

Barberabowman26@gmail.com commented on 11/1/2020 6:42 AM
We should start an open pot. Counter sue Brady and than in return armslist can pay me for using the site. While it returns to its free services! Requardless. The constitution is there for a reason. We have the right to bear arms. We are the people. Against foreign or domestic!
