Policy for Large Size Magazine / Clip / Belts

If your state or local regulations require the magazine or other to be removed, you must inform us immediately after the auction closes—either before you submit payment or at the same time.  Swapping magazines is not an option, only removal.


IMPORTANT BEFORE YOU BUY: Make sure your FFL will receive the firearm for you. If your FFL does not receive the firearm for you for any reason and it gets returned to us, it will be subject to a restocking charge as outlined under Returns.


Returns & Cancellations

We guarantee your order will arrive exactly as advertised and offer a three-day inspection period to ensure everything meets your expectations. If any issues arise, please reach out!

If an order needs to be returned for reasons such as being unable to legally complete the firearm transfer, please note that a 20% restocking fee will apply. 

We do understand that cancellations happen.  If you cancel your order prior to shipment occurring, we will give you a 100% refund.

1. Assumption of Risk
By bidding on, purchasing, or receiving any Product from Malico Industries (“Seller”), the Buyer acknowledges that handling or using firearms and ammunition inherently involves significant risk. These risks include, but are not limited to, serious injury, permanent disability, death, or property damage. The Buyer voluntarily accepts full responsibility for these risks regardless of the Product’s condition.

2. Assessment and Condition Information
Before listing or selling any firearm, ammunition, or related item (“Product”), the Seller and its representatives perform only a visual review of each Product. The Seller does not fire-test firearms, evaluate ammunition performance, or conduct any form of mechanical or safety testing. All descriptions are based solely on what can be observed externally and are provided in good faith, but without any guarantee that the Product is safe, functional, complete, or free from hidden defects. The Buyer understands and agrees that the Seller is not liable for any visible or non-visible issues, including defects that may lead to injury, disability, or death. By completing a purchase, the Buyer agrees to have a qualified, licensed gunsmith examine the firearm prior to using it. Failure to obtain such an inspection means the Buyer accepts all risks and responsibility for any resulting damage, malfunctions, injuries, or other consequences. A professional safety check is strongly encouraged, particularly for used, older, or collectible firearms.

3. Responsibility of Buyer
It is entirely the Buyer’s obligation to confirm that the Product is lawful to own, possess, and use in their specific jurisdiction, including compliance with all local, state, and federal laws. Before using the Product, the Buyer must obtain an inspection from a qualified, licensed gunsmith or armorer to determine safety and functionality. The Buyer is solely responsible for secure handling, operation, storage, and transportation of the Product.

4. Limitation of Liability
To the maximum extent allowed by law, the Buyer agrees to indemnify, defend, and hold harmless the Seller and its affiliates, owners, employees, officers, agents, and assigns from any claims, losses, damages, expenses, or liabilities—including attorney fees—arising from or connected to the purchase, possession, use, misuse, or malfunction of the Product. The Seller is not liable for any type of damages—direct, indirect, incidental, consequential, special, punitive, or exemplary—related to the sale or use of the Product, even if previously advised of the possibility of such damages.

5. Release of Liability and Agreement to Seek Remedies From Other Parties First
By completing the purchase, the Buyer releases the Seller from any and all liability, whether based in contract, negligence, strict liability, or any other legal theory, for injuries or damages associated with the Product. In the event of a dispute or claim, the Buyer agrees to first pursue recovery from any relevant third parties, including but not limited to the Product’s manufacturer, prior owners, distributors, or service providers, before seeking any remedy from the Seller. This applies to the fullest extent permitted by law.

6. Compliance With Laws
The Buyer agrees to follow all rules stated in this listing and those required by GunBroker.com. The Buyer confirms that they are legally eligible to purchase and possess the Product and that no federal, state, or local restrictions prohibit their ownership. The Seller does not make any guarantees about the Product’s legality in the Buyer’s location.

7. Governing Law and Venue
This disclaimer and any disputes arising from the purchase or use of the Product will be governed by the laws of the State of Delaware. Any legal action must be brought exclusively in the state or federal courts located in Macomb County, Michigan, and the Buyer consents to the jurisdiction of those courts.

8. No Liability for Defects
The Seller bears no responsibility for any defects—hidden or obvious—that may be present in the Product, including issues related to design, manufacture, or prior use. The Buyer acknowledges that the Product may contain unknown faults and accepts that the Seller cannot be held accountable for any problems that arise after the sale, especially with pre-owned or used Products.

9. Severability
If any part of this disclaimer is found to be invalid or unenforceable, that section shall be removed, and the remaining provisions shall continue to be fully effective.

10. SOLD “AS IS”
All Products are offered and sold strictly “AS IS” and “WITH ALL FAULTS.” The Seller provides no warranties of any kind—neither express nor implied—including, without limitation, warranties of merchantability, suitability, or fitness for a particular purpose. 11. Entire Agreement
This document represents the complete and final agreement between the Buyer and Seller regarding the items referenced and supersedes all previous statements, understandings, or agreements.

12. Acceptance of Terms
By placing a bid, completing a purchase, or accepting the Product delivery, the Buyer affirms that they have read and understood this disclaimer in full and agree to all conditions contained herein.
